She could theoretically have been declared dead several years ago, but it would have to be done through court proceedings. Many states seem to have a 7 year nissing requirement. If she had been declared dead, she would be found in SSDI. Last I checked she wasn´t there. |
i figured the 7 year rule, but thought there might be a different take on this, given an investigation is still "active", even if "cold". |

I'm not sure how it works with Death in absentia, but the cause of death could be a major point on why this isn't done. I don't know anything about it, but I'd be interested if "cause of death" is on the certificate. |

I'm not sure if it is a seven year rule. I think its done by probability as in likelihood of being dead. |

If she were declared leagally 'dead', would that affect her status with the NH CCU? I tend to think it wouldn't but those dang legal issues, maybe put her colder than cold as far as being an active investigation, thus preventing the family from taking action. I believe there are usually other legal issues such as custody of children, life insurance, ownership of property, etc. that prompts a legally dead declaration. None of which would be an issue in this case except for possibly life insurance. |

I think that during such court proceedings, they would have to present some evidence or indications she is dead, like a LE statement saying they believe her to be deceased. I wonder if they even could meet this requirement? |

Judged: 1 Perhaps an attempt to have her declared legally dead would force LE to present their evidence, thus giving Fred the information he has been seeking for so many years. Can they make him sit outside chambers in that proceeding as well? |
