There have been people from NH and other areas that not only put posters up but continue to search for Maura to this day. Posters are put up but someone keeps removing them. I read the post that JWB is talking about and in no way did you say that you didn't want people to put posters up. If JWB wants them up so bad then he should have some made up and displayed. I think though that with the wind through these mountains, the rain and snow and the snow plows it is hard for a sign or picture to stand up to the elements when stapled on a tree or pole. Displaying something at a business where lots of people go would be the smart thing to do but that's only my opinion which isn't really worth much here on Topix. LOL

Bobjenkins-OG wrote: Emmett I really don't see what your talking about saying this looks like snitch papers. The numbers followed by abbreviations are the case numbers as far as I can tell. What your saying about the discovery phase is definitely true, a snitch can't stay secret forever If the defendant is taking the case to trial. Upon discovery the prosecution needs to show how the case started to determine that true probable cause existed. So the papers your talking about are what the defense learns in discovery. These papers are not discovery documents, this is a traditional arrest report. The first page looks weird to me, namely the sentence, but the rest of it looks like a traditional arrest report. I don't see what your talking about here but that is interesting. Could there be more to this? Could that be the reason for the ridiculously light sentence? I suppose it's possible, but it seems unlikely to me. Only thing that makes that seem possible to me is the light sentence, if that sentence is even accurate. But say she did snitch on someone, whoever sold her the adderrall for example. Not saying that happened, just using it as an example. Let's say she did, it would be months and months before that person ever got to the discovery phase and learned that Maura snitched on him, if it even got that far. Most cases are plead out long before it ever reaches that. That'd sure put an interesting twist on this case, but nothing I've ever seen or read makes me think that's a possibility here. To me it looks like she left school out of shear embarrassment, or possibly was suspended. she caught that charge at the end of the first semester, that means she should've had a disciplinary hearing at the beginning of the second semester. Did she have that hearing and nobody knows about it? It's very possible, I can see her not telling her family about it, maybe wanting to get away for a week to think about how to break the news to her family that she'd been suspended. My question is would umass make it public that she got suspended after she went missing? I can see them maybe leaving that little tidbit out once it appeared she was truly missing. Schools can be weird about PR and maybe they chose to kept that Fact quiet because they thought it would make them look bad. Idk, hard to say, but I can't see her not at least being on disciplinary probation. Where are you getting your information from, Jenkins? Google? IF a defendant were to go to trial on a case where the testimony of a CI was used against him - and the State were to subpoena said witness - the attorney for the witness could file a Motion to Quash based upon promises made by the State in question - IF, and only if, the state made a promise such as 'We will dismiss your charges if you do a drug buy for us - we need nothing further from you.' It's up to the judge's discretion, regarding whether or not to put the witness on the stand - but I'd love to see the case law you are referencing where a CI's personal identifying information was released to a defendant.

Bobjenkins-OG wrote: Jwb- My opinion on it is that clearly it exists but is rarely, if ever, used in practice. Apparently that's the official legal term meaning the prosecution dismissed the charges. From that definition it looks to me like a defendant can't cop to a nolle like they can in other states, but rather that's the prosecution dropping the charges all together. Im definitely a little confused on the matter because I've had a couple different attorneys tell me that nolle's don't exist in mass, that's why I'm under the impression that they exist but are not generally used in practice. A few posts up, you said it didn't exist. You stated it in caps, actually. Glad to see you realized I wasn't bullshitting you. I don't know why you think I would lie to you about something even a novice with Google could understand. You wrote above 'cop to a nolle'. I have no idea what you mean by that, but, there is no such thing as 'copping to a Nolle.' A Nolle Prosequi is not a plea - it is precisely as I have stated in prior posts - and for Wowzer's eyes, I won't reiterate myself - I don't want to be on her poop list.:)

Wow, someone keeps taking down the posters? That's really fucked up if you think about it, who would care enough to actually take down the missing posters? Who the hell is gonng go up and take down a missing poster for a missing person? For some reason I feel like that same person wouldn't be taking down the poster of a missing dog. The only missin posters ive ever seen up were the ones along rt 112 on all the telephone poles several years ago, and those apparently got taken down as well. An citi- if I misinterpreted what you said about putting up posters I apologize.

Bobjenkins-OG wrote: Thanks for posting that jwb. That makes it look like a nolle does exist in mass. What's weird though is every attorney I've ever spoken to said a nolle doesn't exist in mass. I'm confused now. In ct in 1997 I got a charge for simple possession of marijuana. I got a nolle on that case, case was thrown out after a year of not getting arrested again. About 2005, I think it was, an ex-Gf of mine got arrested in Massachusetts. She didn't have the $ for a private attorney so I paid for one for her, freaking $1500 bucks but that's another story. We went and met with 3 attorneys and chose the third one. I specifically asked if we could get the case nolle'd and they all said no, in mass it's called a CWOF. Well two of em said that, I actually asked again because I didn't believe that. Both of them said pretty much the exact same thing:'that doesn't exist, in mass it's called a CWOF' If it really matters maybe someone should call a Massachusetts attorney and ask because according to all attorneys I've spoken to a nolle doesn exist, well at least they're never used. A mass attorney pretty much described that a CWOF and nolle is interchangeable terms for different states. I'm talking about how the law is actually used in practice, not the legal definitions. Any lawyer will tell you that in practice the law is very different than what's taught in law school and the only thing that really teaches you how to be a good attorney is practicing it. I'm well familiar with how the law is used in practice, Jenkins. This is what I do for a living.

Bobjenkins-OG wrote: Simply sarcasm- was that post by advocate from January or more recent? Im just wondering where it came from. One thing I can say for sure is that there's no way in hell a grand jury was gonna be called on this case. It was misuse of a credit card under 250$, a misdemeanor. Grand juries work different in mass as well. A person gets arrested on something, let's say a major drug charge, and is arraigned in district court. After that point there is what's called a bindover hearing. This is to determine whether the case is worthy of having a grand jury called on it. After that hearing a grand jury is called and the grand jury determines whether to indict someone up into superior court. In mass a person can only be sent to state prison from superior court. District court deals with cases where the sentences are 2.5 years and less where the person will be sent to county jail. Most states any sentence over a yr the person gets sent to prison but mass is different like that too, it's 2.5 yrs, and the person needs to be indicted to superior court for that to happen. On Maura's charge there is just no way that she would be indicted or even a bindover hearing would be scheduled. There is absolutely no way a grand jury is going to ever be called on what amounts to a petty larceny charge. If anything Maura was likely running away from the embarrassment. It's been said that the person who's card she used lived in her dorm. That must've been wicked embarrassing for her if she knew that people were talking about it. I can see her wanting to get out of town for a week to try to let people remember how to forget. It was from Feb of 2012. And....the grand jury information was in direct response to posts on the grand jury that was, in fact, convened regarding the disappearance of Maura Murray.

Simply Sarcasm wrote: <quoted text>Some of Bill's posts about you are starting to make sense - you run with supposed 'facts' and draw inferences from those false facts - and it's frustrating. See? It is not just Bill, it is many of us that feel this way. We point out that Jenkins constantly states things as "fact" when they are not. Then everybody has to respond to his non-facts to set him straight, to, as Bill said, set the record straight for others reading this thread, so that Jenkins' non-facts don't get carried forward as if they were true. You are now spending your time refuting Jenkins' "facts" just like many of us have been doing for months now. It is annoying, frustrating and needless, yet he will not stop. Many people have requested that he stop doing this, but he won't. There is a reason people are being mean to him, it's not that we're mean people, we would like a reasonable discussion, and it is NOT POSSIBLE WITH JENKINS.

amy researches wrote: <quoted text> I see what you're saying Jenkins, but didn't RO say she was sure it wasn't temporary plates? I'm not sure on that because I didn't save the posts, so I'm just going off memory. Did you happen to save the old posts? I would like to read them again if you have them. No I don't have them saved but I believe they are archived somewhere. I'll try to take a look and see If I can find them for you to read. From what I remember RO was fairly confident that they were mass plates, she remembered the red writing. But when pointed out that the temp plates had red writing she said that it was possible they were temp plates as she didn't look that closely at the plate. The way she put is it that it's like when you see a car you look down to see what state they're from, buy you dont pay that close attention because your not expecting Someone to go missing. She always felt bad about not looking closer. Now RO is a perfect example of a witness that came forward with information that she knew and was never accused of anything, never harassed like people try to claim any witness who comes out is going to suffer. To me that sounds ridiculous. The only witnesses that were really accused of anything at all were cw & the sbd, and both of them had distinct inconsistencies in their statements that warranted being questioned. This whole notion that any witness who comes forward is going to be accused is just ridiculous.
